Procedure 6.2.1: Appeal Process

Rules for Appeal Procedure
- All reference to days means work days excluding weekends and holidays.
- Any notice required shall be in writing and either hand-delivered or delivered via certified mail, return receipt requested.
- Hearings for appeal of personnel actions shall be closed unless the college and the employee agree to hold an open hearing. Only individuals requested by the Board of Trustees shall be present.
- Notification of the intent to have legal counsel by either party is required at least 72 hours prior to the hearing. Legal counsel is permitted strictly in an advisory capacity.
- Any hearing for appeal will be audio recorded by the college. If requested, a written transcript will be provided to the employee. No other recording devices will be allowed.
- The employee may withdraw the appeal at any level and at any time.
Appeals Procedure
- The employee’s request must be made within fifteen days of the disciplinary action or notice of separation due to reduction in force, or the right of appeal is forfeited.
- When notified of the request for an appeal, the President shall inform the Board of Trustees immediately.
- The entire Board or at the discretion of the Board, an ad hoc committee of Board members, will review the decision and conduct a hearing of the facts surrounding the case.
- A decision shall be made within thirty days of the receipt of the request for the appeal. The decision of the Board is final and shall be binding.
